As you know, the Fishing Rules allow the use of net fishing gear (nets, wicks, net) for recreational fishing only in fishing areas. And so the deputies and the Government of the Russian Federation made a gift to amateur fishermen living in the regions of the North and Siberia. Article 9 of the Federal Law "On amateur fishing …" allowed the use of net fishing gear in these areas, of course, only to satisfy personal needs. Indeed, there is a category of citizens who cannot survive without fishing nets. And in order to control such fishing, the law provides for mandatory marking of net fishing gear with the registration number and name of the owner. Everything should be under control, and these duties should be performed by specialists of the territorial departments of the Federal Agency for Fishery. These rules of law, as you know, come into force on January 1, 2020.
The development of this law was the Decree of the Government of the Russian Federation of November 16, 2019 No. 1462 “On the peculiarities of circulation and use of gill nets in the regions of the North, Siberia and the Far East of the Russian Federation”. The Decree now only refers to the use of gill nets. What to do with other net fishing gear (wicks, ravings) has not yet been decided. Apparently, another Resolution will be issued. So in this Decree it is clearly stated that the use of networks is allowed in all subjects of the Russian Federation in the area of activity of the Verkhneobsk Technical University of the Federal Fisheries. But the Kemerovo region was not included in this list. Apparently, Moscow decided that the Kemerovo region does not belong to Siberia.
There is still a curious condition. Paragraph 4 of this Regulation reads as follows:
4. In the implementation of recreational fishing is prohibited:
– “use gill nets without an identity document of the person carrying out their application.” This requirement is understandable – you cannot fish nets without a document!
But how to implement another requirement – “to leave the gill nets installed on the water body without the control of the person implementing them”. That is, if a fisherman put up a net in the lake or in the river in winter, and the Fishing Rules allow them to be set for three days, then he must sit next to the nets until he removes them. Or tie a dog for control?
But I haven’t found it anywhere, but how many nets can an amateur fisherman mark in TU Rosrybolovstvo? And most importantly, what kind of networks can these be? After all, paragraph 35.2 of the Fishing Rules has not been canceled:
35.2. In recreational fishing, the use of net fishing (fishing) tools from fishing line (monofilament) is prohibited. Namely, such nets in most cases are now used by fishermen.
Until the New Year, there is very little left. And there are plenty of questions about fishing with nets. We will wait for clarifications!
